CLINIC TERMS & CONDITIONS
Acceptance of Terms
By purchasing a Skystone Eagle Silversmithing Clinic through the Skystone Eagle website, you acknowledge that you have had the opportunity to read these Clinic Terms & Conditions and agree to comply with all applicable Skystone Eagle clinic policies, terms, conditions, safety requirements and participant expectations.
By completing a purchase, these Terms & Conditions form part of the agreement relating to your booking and attendance at the clinic.
If a booking is made on behalf of another person, the purchaser is responsible for ensuring that the participant is made aware of these Terms & Conditions. All participants are required to comply with the clinic’s safety requirements and reasonable instructions given by the instructor.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available under the Australian Consumer Law or other applicable Australian legislation.

1. Participant Cancellations & Illness
If you become unwell or are otherwise unable to attend your booked clinic, please notify the person running the clinic as soon as reasonably possible.
Early notification allows Skystone Eagle, at its discretion, to determine whether the booking can be transferred to another participant or whether the vacant place can be offered to another person.
Where sufficient notice is provided, Skystone Eagle may, at its discretion, offer the participant the opportunity to transfer their booking to another available clinic date, subject to:
- availability of another suitable clinic date;
- availability of a place in the clinic;
- Skystone Eagle still operating or travelling in that area; and
- approval by Skystone Eagle.
Alternatively, where circumstances allow, Skystone Eagle may arrange for the booking to be transferred to another person nominated by the original participant.
Notification of illness or inability to attend does not automatically guarantee a refund, transfer or replacement clinic. Any transfer or alternative arrangement is at the discretion of Skystone Eagle and is subject to availability.
Where possible, participants are encouraged to provide as much notice as possible so that Skystone Eagle has a reasonable opportunity to fill the vacated place.

2. Transferring Your Booking to Another Person
If you are unable to attend your booked clinic, you may nominate another person to attend in your place.
Please contact Skystone Eagle as soon as possible so the booking can be transferred into the new participant’s name.
The replacement participant will be required to comply with all Skystone Eagle Clinic Terms & Conditions and safety requirements.

3. No-Shows
Clinic places are limited and are reserved specifically for the participant and date selected at the time of booking.
If a participant does not attend their scheduled clinic and has not contacted Skystone Eagle beforehand, the booking will be treated as a no-show.
A no-show does not automatically entitle the participant to a refund or transfer.
Where a participant is unable to attend because of illness, emergency or unforeseen circumstances, they are encouraged to contact Skystone Eagle as soon as reasonably possible. Skystone Eagle may, at its discretion, offer a transfer to another available clinic date.

4. Cancellation by Skystone Eagle
If Skystone Eagle is required to cancel a clinic, participants will be offered the choice of:
- transferring their booking to another available clinic date; or
- receiving a refund of amounts paid for the cancelled clinic.
Any refund or other remedy will be provided in accordance with the Australian Consumer Law and any other applicable Australian legislation.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee or other right that cannot lawfully be excluded, restricted or modified.

5. Silversmithing Safety
Silversmithing involves working with potentially hazardous equipment, materials and processes, including but not limited to:
- open flames and torches;
- high temperatures and hot metal;
- sharp tools and equipment;
- hammers and striking tools;
- chemicals, acids, fluxes and pickle solutions;
- soldering equipment;
- heated surfaces; and
- other workshop equipment and materials.
Participants will receive instruction regarding the safe use of equipment and must follow all reasonable safety instructions provided by Skystone Eagle.
Participants must use equipment only as instructed and must behave in a manner that does not place themselves, the instructor or another participant at risk.
Any injury, accident, equipment damage or unsafe condition must be reported to the instructor immediately.

6. Alcohol, Drugs & Fitness to Participate
Participants must not attend or participate in a clinic while affected by alcohol, illegal drugs, or any medication or other substance that may impair their judgement, coordination, awareness or ability to participate safely.
Skystone Eagle reserves the right to refuse participation or require a participant to leave where, in the reasonable judgement of the instructor, the participant appears impaired or is unable to participate safely.

7. Respectful & Inclusive Environment
Skystone Eagle is committed to providing a safe, welcoming and respectful environment for everyone attending its clinics.
Bullying, harassment, threatening behaviour, intimidation, abusive behaviour, unlawful discrimination, or derogatory or offensive conduct towards another participant, the instructor or any other person attending the clinic will not be tolerated.
Participants must not engage in behaviour that makes another participant feel unsafe, intimidated, humiliated or unwelcome, or that seriously disrupts the clinic or prevents others from enjoying their experience.

8. Participant Conduct & Removal
Skystone Eagle reserves the right to require a participant to leave a clinic where their behaviour is unsafe, abusive, threatening, harassing, unlawfully discriminatory, seriously disruptive, or otherwise prevents the clinic from being conducted safely and respectfully.
Where reasonably possible, the participant will first be given an opportunity to correct their behaviour.
If the behaviour continues, or where the instructor considers immediate removal necessary for the safety or wellbeing of any person, the participant may be asked to leave without further warning.
Where a participant is removed because of their own unsafe, threatening, abusive or seriously disruptive conduct, they will not ordinarily be entitled to a refund or replacement clinic, subject to any rights or remedies that cannot lawfully be excluded under Australian law.
Skystone Eagle will not use this provision to unlawfully discriminate against any participant. Decisions regarding participation or removal will be based on conduct, safety or the proper and respectful operation of the clinic.
If a participant refuses to leave after being directed to do so, or if the instructor feels threatened or unsafe, Skystone Eagle may contact venue security or NSW Police as appropriate.
Nothing in these Terms & Conditions authorises Skystone Eagle or any participant to use unreasonable physical force.

9. Participant Responsibility
Participants are responsible for following safety instructions, taking reasonable care of themselves and others, and behaving appropriately throughout the clinic.
Participants must advise the instructor of any circumstance that may reasonably affect their ability to safely participate in the clinic.

10. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law (ACL) or other applicable Australian legislation.
Where the law provides a participant with a right to a refund, cancellation, compensation or another remedy, those rights continue to apply.
Skystone Eagle’s Terms & Conditions are intended to operate alongside, and not replace, any rights provided to consumers under Australian law.
